Joseph Clark, 57, was given the death penalty in November 1984 for the death of David Manning in Toledo, Ohio. 20 years later, in May 2006, Clark was executed by lethal injection, which took over 90 minutes. Clark’s mother has now filed a claim against Ohio prisons for unconstitutional cruel and unusual punishment.
According to prison officials and the Associated Press, when Clark was to be executed they had a hard time finding a usable vein. When they did find a vein to use, the vein collapsed immediately. It is also stated that the person who was administering the drugs had put it in the original IV line by mistake. As Clark was given the first injection, or the attempt to give the first injection, Clark yelled “It don’t work”. When the second attempt to give the injection came, Clark once again yelled out “Can you just give me something by mouth to end this?”.
Clark’s mother is not the only person who has filed a complaint against Ohio prison system and how lethal injection is carried out. In another lawsuit filed against the prisons, 15 inmates have challenged Ohio’s injection process stating that the lethal injection process may cause inmates to suffer more during the execution process. The problems that have come about have led Ohio to change the lethal injection process by making sure a vein can be found before the process has started. However in May another inmate who was executed by lethal injection, Christopher Newton waited nearly two hours to die before the execution process was finished.
According to the Clark County Prosecutor’s, Clark’s execution was also made public since he was one of Ohio’s longest serving inmates. Clark served a total of 21 years and five months on death row. He also gave one of the longest final statement’s in Ohio’s history of executions, nearly 10 minutes. In Clark’s final statement he thanked his family and his friends. He apologized to the victims families for the pain he had caused, and clearly stated the dangers of drug use. Clark also quoted Martin Luther King, Jr.. and then said:
“I would like to tell them young brothers and sisters also all over the world, do not let drugs ruin your life, ruin your body, and destroy your mind. Today my life is being taken because of drugs. If you live by the sword, you die by the sword.”
